In December 2007, I was pulled over and falsely charged with DUI in Columbus, OH. At the time, I was a resident of Ohio, but had plans to move to California the following month. I quickly hired an attorney and challenged the DUI charge.

In January, I permanently relocated to California and obtained a CA driver’s license. Since the DUI charge had not been resolved in Ohio, it transferred to my California cruising record when I applied for a CA license. In April, the Ohio court dismissed my DUI charge and amended the conviction to a simple "Failure to Use Turn Signal."

I recently purchased a vehicle and tried to get insurance, merely to be denied because my California cruising record showed a "Failed Chemical Test."

I previously obtained a copy of my Ohio cruising record to make sure the DUI had been completely amended, and it was. I’m assuming that the transferred over to my CA record when I initially applied for a CA license in January ‘08, but was not removed when the charge was cleared in April ‘08. The woman at the insurance company did say, however, that both the "Failed Chemical Test" and the "Failure to Use Turn Signal" showed up on my CA cruising record.

How do I get this charge, for which I was not convicted, permanently removed from my record?

    First you need to know whether the insurance company does not want to insure you because you were ARRESTED for DUI, regardless of what the outcome was.
