Can I still get my CNA liscence with an undisposed DUI charge?

Here’s my story; I just completed a CNA program and passed the tests from the state of Florida, so I was expecting my liscence in the mail. What I got was a letter from the Department of Health stating that they needed some more info from my background check. Back in 2005 I was arrested for DUI, but the case is still undisposed, due to my lawyer fighting the case because the breathalyzer machine has been proven faulty. What I am really asking is if I do some they work they are requesting, ie- 3-5 letters of recommendations, the dipositions of the charges on my background check, and a letter of what I’ve done since the arrest to improve my life; are they still going to deny me my liscence even though I have passed some the tests? And If they do deny me what should I do next? Write the governor, Charlie Crist?

They will not deny you if you submit the requested info, writing the Gov would not help and the only thing that will keep you from getting your license is a recent drug conviction.~
